
PUBLIC OFFER AGREEMENT
ON MAKING A CHARITABLE DONATION

This public offer to provide a charitable donation (hereinafter referred to as the "Offer") is addressed to an indefinite circle of individuals and legal entities who visit the official website of the CHARITABLE ORGANIZATION "CHARITY FUND "COMMUNITY UNITY" on the Internet at the link: https://fondunity.org (hereinafter referred to as the "Website"), and constitutes an official and public proposal of the CHARITABLE ORGANIZATION "CHARITY FUND "COMMUNITY UNITY", legal entity identification code (EDRPOU) 39056806, located at: 4 Oleny Pchilky Street, Apartment 515, Kyiv, 02129, Ukraine (hereinafter referred to as the "Foundation"), represented by its President, Melnychuk Oleksandr Vasylovych, acting on the basis of the Articles of association, to conclude an agreement on making a charitable donation (hereinafter referred to as the "Agreement") under the conditions described in this Offer, with any Donor who applies.
Terms and Definitions

Public Offer – a valid proposal of the Foundation posted on the Website to provide a charitable donation, directed to an indefinite circle of individuals and legal entities.

Acceptance – full and unconditional acceptance of the Offer by performing actions aimed at making a money transfer using payment forms and tools located on the Website, or by transferring funds to the current account of the Foundation through banking institutions. The Offer is considered accepted from the date the funds are credited to the Foundation's current account. Acceptance means the Donor's acknowledgment and agreement with all the provisions of the Offer and the Agreement and, accordingly, the conclusion of this Agreement between the Foundation and the Donor.

Charitable Donation – a gratuitous transfer of funds by the Donor into the ownership of the Foundation for subsequent transfer to Beneficiaries to achieve certain goals of charitable activity provided for by the Statute or programs of the Foundation, in accordance with the Law of Ukraine "On Charitable Activity and Charitable Organizations", the Statute of the Foundation, and this Agreement.

Donor — a legally capable individual or legal entity that has performed the Acceptance of the Offer.
1. Subject of the Agreement
1.1. The subject of this Agreement is the gratuitous and voluntary transfer of funds from the Donor to the ownership of the Foundation by making voluntary donations for the implementation of the statutory goals and activities of the Foundation, as well as the provision of charitable assistance by the Foundation in accordance with the Law of Ukraine "On Charitable Activity and Charitable Organizations" and charitable programs of the Foundation.
1.2. The volume and size of charitable donations shall be determined by the Donor independently at their own discretion.
1.3. The Foundation shall independently determine the directions of using the charitable donation within its own statutory activities, unless otherwise specified by the Donor in the manner prescribed by this Agreement.
1.4. At their discretion, the Donor may indicate the targeted purpose of the charitable donation by choosing it among the programs (projects) or goals announced by the Foundation on the Website.
1.5. Performance of the terms of the Offer by the Parties does not aim at obtaining profit or any benefits for either Party.
2. Acceptance of the Offer
2.1. By Accepting the Offer, the Donor certifies that they agree to all the terms of the Offer, with which they have familiarized themselves on the Website. Furthermore, by accepting the Offer, the Donor fully understands and agrees with the subject of this Agreement, the purposes of public fundraising, and confirms the right of the Foundation to use a part of the Charitable Donation for the administrative expenses of the Foundation in an amount not exceeding that specified in the Law of Ukraine "On Charitable Activity and Charitable Organizations".
2.2. The Parties agree that from the moment of accepting the Offer, this Agreement is considered concluded in writing in accordance with Articles 207, 639, 641, and 642 of the Civil Code of Ukraine and Article 7 of the Law of Ukraine "On Charitable Activity and Charitable Organizations". At the same time, the Parties agree that after the acceptance is made, the failure to sign this Agreement as a separate document does not entail its invalidity.
3. Rights and Obligations of the Parties
3.1. The Foundation has the right to:

Receive charitable donations and use them in accordance with the subject and terms of this Agreement and the Statute of the Foundation;

Without additional approval from the Donor, change the directions of using the charitable donation within its statutory activities (if the donation was not targeted);

Without approval from the Donor, use a part of the charitable donation for the administrative expenses of the Foundation in an amount not exceeding that provided for by the legislation of Ukraine.
3.2. The Foundation is obliged to:

Use the received charitable donations in accordance with the subject and terms of this Agreement and the Statute of the Foundation;

Report on the use of charitable donations in the manner prescribed by this Agreement;

Maintain the confidentiality of information (including personal data) received from the Donor, and not transfer it to third parties without the Donor's consent, except in cases established by the effective legislation of Ukraine.
3.3. The Donor has the right to:

Transfer a voluntary charitable donation to the account of the Foundation in the manner specified in the Agreement and on the Website;

Apply to the Foundation to obtain a report on the use of charitable donations.
3.4. The Donor is obliged to:

Thoroughly and carefully familiarize themselves with all the terms of the Offer prior to making a charitable donation.
4. Place and Terms of Collecting Charitable Donations
4.1. Public collection of donations is conducted on the territory of any country of the world in the manner prescribed by Art. 7 of the Law of Ukraine "On Charitable Activity and Charitable Organizations". The direct activity of the Foundation related to the public collection of donations under the Agreement is conducted at the location of the Foundation.
4.2. Public collection of charitable donations on the basis of this Agreement is carried out throughout the entire period of the Foundation's activity until its termination (liquidation), unless otherwise determined by the decision of the competent management bodies of the Foundation.
4.3. The Donor agrees that in case of non-realization of specific projects (fundraisers) or in the presence of remaining funds, such donation amounts are non-refundable and will be used by the Foundation for the general statutory activity of the Foundation.
5. Procedure for the Use and Return of Donations
5.1. The use of charitable donations collected under the Agreement shall be carried out in accordance with the purpose, goals, directions, and tasks of the Foundation's activity specified in its Statute.
5.2. Charitable donations received by the Foundation may be returned to the Donor exclusively in cases directly provided for by the effective legislation of Ukraine and this Agreement.
6. Liability of the Parties
6.1. In case of failure to perform or improper performance of their obligations provided for by the Offer, the Parties shall bear liability in accordance with the effective legislation of Ukraine.
6.2. The Foundation shall not be liable for the actions/omissions of third parties (including payment systems, banks, internet service providers), as a result of which the Foundation was unable to receive funds on time or fulfill its obligations.
6.3. All expenses for the payment of commissions, fees, and other charges related to the transfer and crediting of the charitable donation shall be borne by the Donor.
7. Reporting of the Foundation
7.1. Access to reports on the use of charitable donations is granted to the Donor upon their written request.
7.2. The Foundation also regularly publishes general reports on received donations and the results of its activities on its official Website.
8. Term of the Offer and Amendments
8.1. The Public Offer enters into force from the moment it is posted on the Website and remains valid until the liquidation of the Foundation or until an updated version of the Offer is published.
8.2. The Foundation has the right to unilaterally amend the terms of the Offer at any time by publishing a new version of the Offer on the Website. The Donor shall independently track changes to the terms of the Offer.
9. Confidentiality and Personal Data Protection
9.1. By accepting the Offer, the Donor confirms that they are familiar with Annex 1 to this Agreement and give their voluntary consent to the collection, processing, and use of personal data in the manner prescribed by this Annex and the Privacy Policy of the Foundation.
9.2. The Donor agrees that after providing information about themselves on the Website, they may be sent reports, letters, and information notices from the Foundation, including in electronic form (email, messengers).
9.3. The Foundation shall not be liable for the disclosure of personal data that occurred as a result of unlawful actions of third parties (cyberattacks, etc.), or in the event that such disclosure occurred with the consent or through the fault of the Donor themselves.

to the Public Offer Agreement on making a charitable donation
CONSENT-NOTICE
on the collection, processing, and use of personal data
I, the Donor, who has accepted the Public Offer on making a charitable donation to the CHARITABLE ORGANIZATION "CHARITABLE FOUNDATION "COMMUNITY UNITY" (hereinafter referred to as the "Foundation"), in accordance with the Law of Ukraine "On Personal Data Protection", knowingly and voluntarily give my consent to the Foundation for the automated, as well as without the use of automation tools, processing (including collection, accumulation, storage, and use) of my personal data, which is voluntarily provided by me during interaction with the Website or making a donation, namely: last name, first name, patronymic (if any); phone number; email address; payment details (within the limits transferred by the payment system); technical data (IP address, cookies, device data).
Purpose of processing: ensuring the implementation of civil, economic, administrative, tax, and accounting relations; fulfillment of the statutory goals of the Foundation; informing about projects and reporting on the use of donations in accordance with the Law of Ukraine "On Charitable Activity and Charitable Organizations".
By this document, I also give my consent to the transfer (dissemination) of my personal data exclusively for the purpose specified above and in the manner prescribed by the Law of Ukraine "On Personal Data Protection". I do not require notification regarding the transfer of my personal data to third parties if such transfer occurs for the purpose of executing this Agreement or the requirements of effective legislation.
By signing this consent-notice, I confirm that I have been notified in writing about the inclusion of my personal data in the personal data base of the Foundation, the purposes of data processing, as well as my rights provided for by Article 8 of the Law of Ukraine "On Personal Data Protection", according to which the personal data subject has the right:
1) to know about the sources of collection, location of their personal data, the purpose of its processing, location and/or place of residence (stay) of the owner or processor of personal data, or to give a corresponding mandate to obtain this information to persons authorized by them, except in cases established by law;
2) to receive information about the conditions for granting access to personal data, including information about third parties to whom their personal data is transferred;
3) to access their personal data;
4) to receive, no later than thirty calendar days from the date of receipt of the request, except in cases provided for by law, an answer as to whether their personal data is being processed, as well as to receive the content of such personal data;
5) to submit a reasoned request to the owner of personal data objecting to the processing of their personal data;
6) to submit a reasoned request for modification or destruction of their personal data by any owner and processor of personal data, if these data are processed unlawfully or are inaccurate;
7) to protect their personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, failure to provide, or untimely provision, as well as to protect against the provision of information that is inaccurate or damages the honor, dignity, and business reputation of an individual;
8) to lodge complaints regarding the processing of their personal data with state authorities and officials authorized to ensure personal data protection, or with a court;
9) to apply legal remedies in case of violation of the legislation on personal data protection;
10) to enter reservations regarding the limitation of the right to process their personal data when giving consent;
11) to withdraw consent to the processing of personal data;
12) to know the mechanism of automatic processing of personal data;
13) to be protected against an automated decision that has legal consequences for them.
This consent-notice is valid for an indefinite period (the period necessary to achieve the purpose of processing).
